At neerg Technologies Inc., ("neerg" or "we"), we respect your right to privacy and care about how your personal information is used. On our website, http://www.neerg.com (the "Site"), you may browse and purchase products from our merchants, participate in the community, and, if you are a merchant, you may display, sell and promote your products and your business. This Privacy Policy, along with our Terms of Use and Copyright and Intellectual Property Policy, govern the use of the Site and the associated services provided by neerg, including how we treat the personal information we collect and receive from you.

SCOPE OF PRIVACY POLICY

This Privacy Policy governs any user who visits, submits information to, purchases or sells from, or otherwise uses the Site or any of neerg's related services, except as set forth below.

General Information :

• neerg will not sell or disclose your name or email address to third parties without your explicit consent, except as specified in this Privacy Policy.

• neerg's server logs automatically receive and records information from your browser, including your IP address, cookies, and the pages you request. This data does not identify you personally and is only used by neerg in the aggregate.

• neerg and/or its service providers use your personal information for the following general purposes: products and services provisioning, billing, identification and authentication, services improvement, contact, research, and anonymous reporting.

We respect the privacy of parents and children and are committed to complying with the Children's Online Privacy Protection Act ("COPPA"). If a parent believes that his or her child has provided us with personal information, he or she can contact us via e-mail or postal mail as listed below. We will promptly delete the information upon learning that it relates to a child under the age of 13. If we learn that a user of the Site who is under 13 is publicly posting or sharing personally identifiable information, the user will be blocked from accessing these areas of the Site.

TYPES OF PERSONAL INFORMATION WE COLLECT

neerg receives and stores any information you enter on our Site or otherwise provide to us, including information that is generated by your activities on our Site. Some of the information, like your name and email address, will identify you personally and some, like your computer's IP address, will not reveal your specific identity but may be used in the aggregate. We may use the information that you provide for such purposes as opening your account, processing your orders, responding to your requests, communicating with you, customizing your experience, and for research. You also have the opportunity to share additional information with us and other users in order to express yourself on the Site.

Here are the types of information we collect and/or that you may share:

Registration . You may browse the sight without becoming a registered user. If you choose, you may become a registered user by creating an account with us. When you create an account, we require that you supply certain personally identifiable information such as your name and e-mail address, If you wish to become a merchant and sell products, you may be asked to provide additional information related to you and your business, such as your business name, address, and phone number.

Purchases and Payment Processing . If you choose to purchase products from a merchant on our Site, you must be a registered user. The actual purchase will be handled by Amazon Payments. In order to buy or sell items and send or receive payments, you are required to have an account with our third-party payment service provider, Amazon Payments, Inc., which may request additional information such as your full name, billing address, and banking or credit card information. User Generated Content. You may also choose to post content to the Site including articles, ratings, forum postings, blog entries, photos, videos, and other content that you own or have the right to display and reproduce. Such content will be viewable by us and anyone else who views or uses the Site.

User Home Page . Every registered user has a home page that is accessible by anyone who uses the Site (a "User Home Page" or "My neerg Page"). Your User Home Page is how you present yourself to the community. Some of the information on your User Home Page is provided by you and some is generated automatically by your activities on the Site. As a registered user, you may update your User Home Page and adjust certain settings. If you are a merchant selling on our Site, then your shop home page links to your User Home Page.

Feedback. We may ask you for feedback on products you have purchased or other users with whom you have had transactions. Providing feedback is optional.

Surveys, Special Contests or Promotions. We may occasionally present a survey, special contest or promotion that is sponsored by neerg or by another company. If you choose to participate in such survey, contest or promotion, you may be required to provide certain personal information. If we plan to share your personal information with the sponsor(s) or with others, we will provide a statement to that effect in the survey, contest or promotion terms.

Computer and Connection Information. Our servers automatically collects and analyzes information provided to us by your computer (or other internet-enabled device) when you connect to and use our Site, such as browser type and version, operating system, and platform. We also collect and store your Internet Protocol ("IP") address. An IP address is a unique string of numbers that is assigned to your computer by your internet service provider. Web servers automatically identify your computer by its IP address. We may use your IP address to help diagnose problems with our server and to administer our Site. Clear Gifs (Web Beacons/Web Bugs). Clear gifs are tiny graphics with a unique identifier, similar in function to cookies. We may use clear gifs to track your online movements for statistical purposes to improve the services we provide. As with cookies, clear gifs are not personally identifiable. URL Click Steam. We may collect the full Uniform Resource Locator ("URL") click-stream to, through, and from our Site, including any time and date information associated with it. Such information is not personally identifiable.

Page Interactions. We may use software tools such as Flash or JavaScript to collect page interaction information (clicks, drags, hover-overs) as well as information about page response times, errors, and length of visits to certain pages. Again, such information is not personally identifiable.

HOW WE USE YOUR PERSONAL INFORMATION

Buying and Selling. If you choose to buy or sell product(s) on the Site, as part of the transaction process, the buyer or the merchant, as applicable, and certain third-party service providers, including Amazon Payments, will have access to certain of your personal information as necessary to effectuate the transaction. We may maintain records of your selling and purchasing activities on the Site. Merchants may also access historical order records showing transactions between them and buyers who purchased their products. Records maintained by merchants are governed by the policies of the particular merchant and not by neerg.

Customized experience. We may use your personal information to customize the content, services, goods and advertising you view on the Site or receive from neerg.

Administrative or Service-Related Messages. From time to time, we may send to you important notices or information regarding the Site, for example changes to our terms, conditions, and policies. Because this information governs your use of the Site, you may not opt-out of receiving such communications. If you do not wish to receive them, you can deactivate your account by emailing support@neerg.com.

E-mails; Physical Mailings . If you register with our Site, we may send you e-mail messages or postal mail informing you of our products and services and also third party products and services we believe may be of interest to you. The e-mails we send may contain code that enables our database to track your usage of the e-mail, including whether the e-mail was opened and/or what links (if any) were clicked. We may combine such information with other information we have about you and may use this information to improve or customize your experience on our Site. You can opt out of receiving such messages by un-checking the designated box when you register with the Site. You may also change your subscription or unsubscribe at anytime by using the "unsubscribe" link in any such email we send you or by emailing us at support@neerg.com.

Friend Features. "Invite a Friend" is a feature in which members can send email messages to invite someone to join neerg. "Tell a Friend" allows members to share information about a specific item listed on the Site by sending a personalized email message. If you choose to use either of these features, neerg will ask for the information needed to send the message, such as your friend's email address. neerg will then automatically send your friend an email, inviting your friend to visit the site. Your friend may utilize the "unsubscribe" link in the email to opt-out of receiving future "Invite a Friend" or "Tell a Friend" emails from neerg.

WHO YOUR PERSONALLY IDENTIFIABLE INFORMATION IS SHARED WITH

Other Users. Your username is displayed throughout the Site, and is therefore is viewable by other neerg users. It is also connected to all of your activities on neerg. Other users can see your items for sale, feedback, ratings and associated comments. If you use forums, chat rooms, or other areas of our Site where you post your own content and participate in the neerg community, any personally identifiable information you submit there can be read, collected or used by other users of the Site, and could be used to send you unsolicited messages. We are not responsible for the personal information you choose to submit in these areas of the Site

Buyers and Merchants. As part of the buying and selling process, you may obtain another neerg user's email address, shipping address and/or other personal information. Pursuant to neerg's Terms of Use, you have a limited license to use this information for the purpose of effectuating neerg-related communications or transactions. neerg has not granted you a license to use the information for unsolicited commercial messages or for other purposes unrelated to neerg.

Service Providers. We may employ other companies and individuals to perform functions on our behalf or on behalf of our merchants. Examples include sending email or postal mail, analyzing data, providing marketing assistance, processing payment transactions, verifying identity, fraud screening and providing customer service. These third parties may have access to your personal information as needed to perform their functions.

Aggregated Information. We may gather demographic information from you (for example, your age, education level or household income) from time to time. We may share aggregated demographic information with business partners, but not on a specific user basis.

Transfer of Assets. As we develop our business, we may buy or sell certain assets, and, depending upon the transaction, your personally identifiable information may be one of the transferred assets. In the event that we merge with or are acquired by another company, your personal information may be part of the assets transferred to the acquiring party.

CONTROLLING THE USE OF YOUR PERSONALLY IDENTIFIABLE INFORMATION

Choice/Opt-out. As described above, neerg may send you certain communications relating to the Site, such as service-related announcements and administrative messages. Because these notices govern your use of the Site, you may not opt-out of receiving such communications. If you do not wish to receive them, you may deactivate your account by emailing us at support@neerg.com. neerg may also send you newsletters or other emails or physical mailings about new services, promotions, or other noteworthy news. If you would rather not receive such messages, you may un-check the designated box when you register with the Site, using the "unsubscribe" link in any such email we send you or by emailing us at support@neerg.com.

Editing and Deleting Account Information. If your personally identifiable information changes you may modify or update it signing into your neerg account and going to the "My neerg" area. You can deactivate your neerg account entirely by emailing us at support@neerg.com. Please note that your personal information may remain in neerg's records for some period, but will at all times be subject to this Privacy Policy.

Security. The security of your personal information is important to us. We have security measures in place to protect the loss, misuse and alteration of the information under our control. In addition, your neerg account information is protected by a password for your privacy and security. Although we will exercise reasonable care in providing secure transmission of information between your computer and our servers, we cannot ensure or warrant the security of any information transmitted to us over the Internet and we accept no liability for any unintentional disclosure.

Third Parties. Except as expressly provided herein, this Privacy Policy addresses only the use and disclosure of information neerg collects from you and does not cover any third party or any other site, even if such sites are linked to the Site. neerg is not responsible for the privacy or security practices of others to whom you may disclose your information. We do not control, operate or endorse information, products or services on such third-party sites and are not responsible for their content.

ACCEPTANCE OF PRIVACY POLICY

Your use of our Site, including any dispute concerning privacy, is subject to this Privacy Policy and our Terms of Use. By using our Site, you are accepting the terms of this Privacy Policy and our Terms of Use.
